Justification
As part of a project funded by the European Union and carried out in consortium with Avocats sans frontières Belgique and URU, the IFJD is carrying out an activity to support the bringing of organizations and activities of HRDs in the CAR into compliance with legal standards. Indeed, HRDs can find themselves weakened, even exposed to risks due to non-compliance, often through ignorance, of the national legislation governing their structures and their functioning. In addition to reducing this legal risk, this activity also allows the strengthening of organizations and is therefore likely to help them develop their activities and their effectiveness, including by allowing their eligibility for certain funding.
This activity includes the preparation and facilitation of a training workshop intended for 30 Central African HRDs on the legal framework governing their status and their functioning as well as the support of 3 human rights defense organizations (ODDH) with the aim of strengthen their internal structure. In this context, the consultancy includes two missions in Bangui:
- 1ère mission :
- A 3-day workshop, from January 22 to 24, 2025
- 4 and a half days of evaluation intended for the ODDHs selected for monitoring (For each ODDH: 1 day of needs assessment and 1 half-day of presentations of recommendations), from January 27 to 31, 2025
- 2nde mission :
- A 3-day workshop dedicated to monitoring selected SDGs, from April 23 to 25, 2025
The Francophone Institute for Justice and Democracy
Created in 2013, the IFJD – Institut Louis Joinet is an NGO whose aim is to analyze, strengthen and implement mechanisms linked to the processes of transition, truth, justice and reconciliation. It deploys its activities in France and around the world. It stands out for the academic expertise of its members, placed at the service of its commitments and the quality of its educational, scientific and operational activities.
To support the fight against impunity serious violations of human rights, as well as to promote, particularly following a dictatorship, an armed conflict or an acute political crisis, but also within the framework of the democratic strengthening of a State, the emergence of a peaceful and reconciled societythe Institute is organized around three complementary activity centers: reflection, training and operational action, within the framework of a policy of action research.
The IFJD has solid experience in the Central African Republic where it has been operating since November 2015, with a reinforced presence since 2017 and an office created in Bangui in 2019. Through its expertise and experience in the field, the IFJD is established in the Justice sector, of which he knows the issues, challenges and players. It intervenes through the implementation of several projects whose activities are oriented around four main themes:
- Direct and indirect assistance to victims of sexual and gender-based violence through the care of victims and the training of professionals in the criminal justice system of today and tomorrow, the dissemination of the law and support for research
- Indirect assistance to populations autochtones
- Support for DDH
- Support for Transitional justice
Objective and methodology
The consultancy covers:
- Writing a rapport initial on the legal framework governing the status and operation of HRDs in the CAR and with particular attention to the legal obligations relating to the main areas of operation of their organizations (registration, approval, reporting, social and fiscal obligations, financial management);
- The preparation and delivery of a 3-day workshop for 30 HRDs allowing them to be fully informed on the legal framework governing their status and functioning;
- The programming and providing support of 3 ODDHs selected in order to strengthen their internal structure through :
- The establishment for each of a diagnosis accompanied by recommendations,
- A 3-day follow-up workshop.
Deliverables
Before mission 1
- An initial report presenting the legal framework governing the structures and functioning of organizations and activities of HRDs in the CAR, with particular attention to the legal obligations relating to the main areas of operation of the organizations (registration, approval, reporting, social and fiscal obligations , financial management). This report will meet the academic and editorial standards required by the IFJD;
- A detailed agenda for the 3 days of the training workshop for 30 HRDs, presenting the methodology and the planned participatory work;
- The training workshop materials for 30 HRDs (PPT presentation according to the editorial standards requested by the IFJD);
- A diagnostic grid to assess the needs of the 3 selected ODDHs in terms of strengthening their internal structure and to formulate recommendations adapted to each.
After mission 1
- Mission report.
- Training report.
- For each ODDH supported, a report presenting the results of the diagnosis and the recommendations made.
Before mission 2
- Planning for monitoring the 3 SDGs.
- Tool for assessing the implementation of recommendations.
After mission 2
- Mission report.
- For each ODDH supported, a report presenting the progress made and recommendations concerning the measures remaining to be implemented.
Indicative timetable
The consultancy will start on November 29, 2024.
The first workshop will start on January 22, 2025, for a duration of 3 days.
The establishment of diagnoses and recommendations to the 3 ODDHs will be carried out following the workshop, between January 27 and 31.
The second workshop will start on April 23, 2025, for a duration of 3 days.
Intellectual property
All documentation relating to the mission remains the exclusive property of the sponsor, in this case the IFJD within the framework of the project financed by the European Union.
Profile of the consultant
The offer is open to international and Central African consultants. It is possible to apply as a team, a maximum of 2 people will participate in the workshop organized in Bangui.
To carry out the tasks described in these terms of reference, the interested consultant must have the following qualifications:
• Very good knowledge and mastery of the Central African legal framework for HRD organizations and activities;
• Solid experience in organizational audits and/or management and administration of organizations;
• Solid experience working with national partners of varying sizes, particularly in sub-Saharan Africa;
• Be available during the completion of the contract and fully available during the completion of the two missions in Bangui;
• Experience in carrying out at least 2 similar consultancies;
• Strong commitment to strengthening the capacities of HRDs and civil society, with the desire to adopt a participatory and consultative approach;
• Having a good knowledge of the political, administrative and legal environment of the Central African Republic is essential.
How to apply
Submission conditions
1. Composition of the file
The submitted file includes the following documents:
Administrative documents:
▪ A duly signed cover letter addressed to the President of the IFJD;
▪ A brief description of the factors justifying that the candidate is best suited for the mission;
▪ A CV;
▪ Copies of diplomas and other certificates;
▪ Copy of the national identity card;
▪ Copies of any other administrative document deemed important.
Documents techniques :
▪ Understanding the TOR, critical review, recommendations and possible observations;
▪ Details of the recommended working methodology, supplementing or specifying these terms of reference;
▪ A forecast timetable of tasks for carrying out the different stages of the service;
▪ Copies of similar previous materials and training;
▪ A financial proposal, which will include neither the costs of the mission to Bangui (plane ticket, per diem, local transport), nor the logistical costs linked to the organization of the workshop. The IFJD will cover all of these costs, as well as the entire organization of the workshop. The financial proposal will therefore only include the expertise fees, at a maximum cost of €300 including tax per working day.
2. Evaluation of files
The examination of the application files will be carried out by an internal selection committee, on the submission deadline. The IFJD’s internal evaluation criteria and selection procedures will apply.
The evaluation of the technical proposal will be carried out for each file submitted.
